1. Object of the document
This document regulates the conditions of use and contracting (Terms and Conditions) of the moiiscompany.com website (hereinafter, “the Website”). Its purpose is to inform the User about the rules governing access, navigation and purchase of products through this Website, as well as the rights and obligations of the parties. These Terms apply to both domestic and international users. By using this Web Site, the User expressly accepts these terms in their entirety.
2. Identity of the owner of the Web Site
In accordance with the provisions of Article 10 of the Law of Services of the Information Society and Electronic Commerce (LSSI-CE), it is reported that the owner of the Website is moiiscompany (hereinafter “the Company”), with NIF/CIF and registered office in Spain. In application of said law, the Company provides the following identification data: company name, tax identification number (NIF/CIF) and contact e-mail moiiscompany98@gmail.com. All communication with the holder must be made through this email.
3. General conditions of use of the Web Site
The access and use of the Web Site attributes the condition of User and implies the full and unreserved acceptance of these General Conditions of Use. The User undertakes to use the Website, its services and contents in accordance with current legislation, morality, public order and these conditions. In particular, the User undertakes not to:
- Carry out activities that are illicit or contrary to the law (for example, introduce viruses or carry out actions that damage the computer systems of the Website).
- Send unsolicited messages (spam) or unauthorized advertising.
- Disseminate illegal, abusive or obscene content, contrary to law or infringe the rights of third parties (for example, intellectual property or privacy).
The User will be liable to the Company and third parties for any damages caused by the breach of these obligations.
4. Conditions of purchase
Purchases made on this Web Site shall be governed by the following conditions:
- Order process: To make a purchase, the User must select the desired products and follow the purchase process provided by the platform, confirming the order. Once confirmed, a confirmation email will be sent with the order data.
- Payment: Payment will be made by the methods enabled on the Website (credit/debit card, bank transfers, payment platforms, etc.), ensuring the confidentiality and security of the data. The Company does not store sensitive payment data beyond what is strictly necessary for the execution of the transaction.
- Prices and taxes: All product prices are indicated in Euros and, unless otherwise indicated, include the Value Added Tax (VAT) in force in Spain. The corresponding shipping costs will also be detailed in the payment section. The total amount to be paid will be clearly shown before confirming the order.
- Shipping: Orders will be processed and shipped within the period indicated at the time of purchase. In no case will this period exceed 30 days from the acceptance of the order. If any product is not available or cannot be supplied, the Company will inform the User and will reimburse the amount paid within a maximum period of 30 days, returning the full amount. If the refund is not made within this period, the User may claim double the amount due.
- Right of withdrawal and returns: In distance contracts (Internet purchases), the User-consumer has the right to withdraw from the contract within 14 calendar days from receipt of the product, without having to justify the cause. To do so, he/she must notify the Company before the expiration of the term, and then he/she has another 14 days to return the product. The User only assumes the direct costs of return, unless the Company has agreed otherwise or has not duly informed.
- Warranties: The products sold have the legal guarantee of conformity against manufacturing defects. In accordance with current regulations, the minimum legal warranty is three years from the delivery of the product. During the first 6 months it will be presumed that the defects existed at origin. This right is additional to any voluntary commercial warranty that may be offered by the manufacturer. The User must notify the Company of any lack of conformity within a maximum period of two months from its detection.
5. Personal Data Protection Policy (RGPD)
The Company complies with data protection regulations (Regulation (EU) 2016/679 -RGPD- and Organic Law 3/2018 -LOPDGDD-). The personal data provided by the User (e.g. name, address, email, telephone, bank details for payment, etc.) will be processed for the following purposes: (i) Management and maintenance of the contractual relationship (order processing, invoicing, customer service, etc.); (ii) Compliance with legal obligations; (iii) Sending commercial communications related to own products or services, always with the prior consent of the User (which may be revoked at any time). The legal basis for the treatment is the execution of the contract signed with the User and the fulfillment of legal obligations. The data will be kept for the time necessary for the purpose for which they are intended and in accordance with the applicable legal deadlines.
The Company adopts the appropriate technical and organizational security measures to protect personal data, in accordance with the RGPD. Data will not be communicated to external third parties, except when necessary for the provision of the service (e.g. carriers, logistics companies, payment processors) or by legal obligation. No international data transfers will be made outside the European Economic Area without adequate safeguards.
The User may at any time exercise his or her rights of access, rectification, deletion, limitation of processing, portability or opposition, as well as revoke any consent given, by sending a written request to the Company via the e-mail address indicated. You may also file a complaint with the Spanish Data Protection Agency (AEPD) if you deem it appropriate.
6. Cookies Policy
This Website uses its own and third-party cookies for technical, analytical and personalization purposes (for example, to remember sessions, obtain statistical navigation data, personalize content, etc.). Cookies are files sent to the User's browser from the Web Site's server to collect information about browsing the Web Site.
In accordance with the LSSI-CE and privacy regulations, non-essential cookies are only installed if the User has given informed consent after receiving the appropriate information. 7. Age restrictions for use (over 13 years of age)
The online sales services of the Website are intended for users over 13 years of age. According to the RGPD and the LOPDGDD, in Spain the minimum age for a minor to give consent independently is 14 years. Therefore, if the User is between 13 and 14 years old, he/she must have the authorization of his/her father, mother or legal guardian to make purchases on the Website. Minors under the age of 13 are prohibited from registering or using the shopping services.
8. User Responsibilities
The User is liable to the Company or third parties for any damage or harm of any nature that may be caused by improper use of the Website (breach of law, fraudulent use, etc.) or acts and omissions that are contrary to these conditions. Likewise, the User undertakes to maintain the confidentiality of his or her access credentials (username and password), and to use the contents of the Website only for personal use. The Company does not guarantee the absence of errors in accessing or browsing the Website. Nor does it guarantee the continuous availability of the Website or its services, and therefore cannot be held responsible for occasional interruptions or technical failures.
Likewise, the Company is not responsible for the legality or veracity of content provided by third parties (users, forums, external links, etc.) or the use that these third parties may make of the information provided. In particular, it shall not be liable for the contents, activities or practices of third party websites linked from the Website.
In no event shall the Company be liable for indirect, special or consequential damages that may result from the use or inability to use the Website or the products purchased, unless otherwise required by law. The Company's total liability shall be limited to the amount paid by the User for the order giving rise to the claim, to the extent permitted by law.
11. Modifications of the conditions
The Company reserves the right to modify, at any time and without prior notice, these Conditions to adapt them to new legal requirements or changes in the Website. The modifications will be published on this page indicating the date of the last update. The User is responsible for periodically reviewing the Conditions. If any provision is deemed void or unenforceable, this shall not affect the validity of the remaining provisions. The continued use of the Web Site after the publication of changes will imply the acceptance of the same by the User.
12. Applicable Law and Jurisdiction
These Conditions are governed by current Spanish legislation, in particular by the LSSI-CE, the Royal Legislative Decree 1/2007 on the Defense of Consumers and Users and Regulation (EU) 2016/679 (RGPD), among other applicable rules. For the resolution of any dispute that may arise, the parties, expressly waiving any other jurisdiction, submit to the competent Courts and Tribunals of Spain. In any case, if the User is an end consumer, the protective legislation of his country of residence will be applicable in accordance with European Union Law.
